RULES FOR THE PURCHASE AND SALE OF GOODS
- Concepts
1.1. The data controller and operator of the website www.namuimperija.lt (hereinafter - the Data Controller) is UAB "Lumarginta", company code 305711931, VAT taxpayer code LT100013887111, correspondence address - S. Daukanto 4, LT-77171 Šiauliai, Republic of Lithuania, e-mail address – info@namuimperija.lt .
1.2. Buyer - an active natural or legal person who purchased goods in the online store www.namuimperija.lt.
1.3. The rules for the purchase and sale of goods (hereinafter - the Rules) regulate the rights and obligations of the Buyer and the Seller, the prices of the Goods, the payment procedure, deadlines, delivery, the guarantee of the quality of the Goods, the return and exchange of the Goods, and the responsibilities.
- General provisions
2.1. These rules for the purchase and sale of goods (hereinafter referred to as "Rules") are approved by the Buyer when purchasing the goods by pressing the "Finish payment" button. It is a binding legal document for the parties, which sets out the rights and obligations of the Buyer and the Seller, the terms of purchase and payment for goods, delivery of goods and the return procedure, responsibility of the parties and other provisions related to the purchase and sale of goods in the "Namuimperija.lt" online store.
2.2. The seller reserves the right to change, amend or add to the Rules at any time, taking into account the requirements established by legal acts.
2.3. The sales of the online store "Namuimperija.lt" are carried out in Europe.
2.4. You have the right to buy in our online store:
2.4.1. able-bodied natural persons, that is, persons who have reached the age of majority, whose capacity is not limited by court order;
2.4.2. minors from fourteen to eighteen years of age, only with the consent of parents or guardians, except in cases where he is emancipated;
2.4.3. legal entities;
2.4.4. authorized representatives of all the above persons.
2.5. By purchasing and confirming the Rules, the buyer confirms that he has the right to buy goods in the "Namuimperija.lt" online store.
2.6. If necessary or in the presence of circumstances provided for in the legal acts of the Republic of Lithuania, the Seller has the right to change or supplement the Rules. Buyers will be informed about this when connecting to namuimperija.lt or when purchasing goods for the first time after the new rules come into force.
2.7. The Buyer must familiarize himself with the Privacy Policy approved by the Seller. The Buyer expresses consent or disagreement with specific ways of using the Buyer's Personal Data in accordance with the procedure provided for in the Privacy Policy.
2.8. If the seller has the right or obligation to provide documents or information to the Buyer by e-mail, in all cases the Buyer is responsible for providing the Seller with a working e-mail address belonging to the Buyer.
- Protection of personal data
3.1. The Buyer can order goods in the Namuiimperija.lt online store without registering on this website.
3.2. When ordering goods, the buyer must specify his/her personal data necessary for the proper fulfillment of the goods order in the relevant information fields provided by the Seller: name, surname, delivery address, telephone number and e-mail address.
3.3. By approving these Rules, the buyer agrees that his personal data will be processed for the purposes of selling goods and services and evaluating their quality in the online store Namuiimperija.lt.
3.4. The Buyer, agreeing to the processing of his personal data for the purpose of selling goods and services in the Seller's online store, also agrees to the sending of informational messages to the e-mail address and telephone number indicated by him, which are necessary to fulfill the order for goods.
3.5. When placing an order, the buyer can express his consent/disagreement to the use of his personal data for direct marketing purposes. He does this by ticking (I agree to the use of her personal data for direct marketing purposes) or by not ticking (I do not agree). The Seller sends the newsletter several times a month to the e-mail specified by the Buyer. by mail and provides the opportunity to opt out of the newsletter (at the end of the newsletter there is an option: "opt out" - after clicking the link, the Buyer will no longer receive the newsletter).
3.6. The Seller confirms that the personal data specified by the Buyer will be processed only for the purposes of selling goods and services, evaluating their quality in the Namuiimperija.lt e-store, analyzing the Seller's activities and direct marketing (except in cases where the Buyer refuses to have his personal data processed for the purpose of direct marketing) . The Seller undertakes not to disclose the Buyer's personal data to third parties, with the exception of the Seller's partners providing goods delivery, quality assessment or other services related to the proper fulfillment of the Buyer's order. In all other cases, the Buyer's personal data may be disclosed to third parties only in accordance with the procedure provided by the legislation of the Republic of Lithuania.
3.7. The buyer, who wishes to order partner services offered in the Seller's online store, can do so by expressing his consent for his clearly specified personal data to be transferred to the relevant partner for the purpose of providing ordered services.
3.8. In order to evaluate the quality of the goods purchased by the buyer, the customer may be contacted by e-mail after the order has been fulfilled. by mail and please leave feedback and evaluate the purchased product. For this purpose, the buyer's email mail may be transferred to third parties.
3.9. After visitors subscribe to the Home Empire newsletter and submit their e-mail address. mail, it may be transferred to third parties.
- The moment of conclusion of the purchase-sale contract
4.1. The buyer can order goods in the following ways:
4.1.1. by registering online at Namuimperija.lt;
4.1.2. without registering online at Namuimperija.lt;
4.1.3. by phone;
4.1.4. in an office, warehouse, store;
4.2. The contract between the Buyer and the Seller is considered to be concluded from the moment when the Buyer, after choosing the product(s) to be purchased and creating a shopping cart, clicks on the "Complete payment" link and when the Seller contacts the Buyer by phone or e-mail. by mail, confirms the order by sending a letter by e-mail by mail about the order confirmation.
4.3. Each purchase-sale agreement concluded between the Buyer and the Seller is registered and stored in the database of the "Namuimperija.lt" online store.
- Buyer's rights
5.1. The buyer has the right to purchase goods in the Namuiimperija.lt online store in accordance with the procedure set out in these Rules and other information sections of the Seller's online store.
5.2. The buyer has the right to get acquainted with his personal data and the right to demand the correction of incorrect, incomplete, inaccurate personal data by writing an e-mail to a letter info@namuimperija.lt or by calling the number 8 60439311 . In this case, the seller must immediately implement the buyer's request (within 1-2 working days if this is possible and the order is not final).
5.3. The buyer has the right to withdraw from the contract for the purchase and sale of goods concluded with the Namuiimperija.lt online store, by notifying the Seller in writing (by e-mail, specifying the item to be returned and its order number) no later than within 14 calendar days from the day of delivery of the item.
5.4. The user has the right to withdraw from the contract concluded online (in other words, to return a quality product) within 14 days without giving a reason (Article 6.228 (10) of the Civil Code), except for paragraph 2 of this article. an exception is provided. The money paid, including the delivery costs paid by the buyer, must be returned to him no later than 14 days from the day of the buyer's notification of withdrawal from the contract. The seller may not issue a refund until they receive the item or receive proof that the item has been shipped.
5.5. The buyer can use the right to refuse the purchase of goods - sale contract only if the goods have not been damaged or their appearance has not fundamentally changed, and they have not been used, assembled and remained in their original packaging.
5.6. A buyer who has purchased a product of inadequate quality (2-year legal guarantee for the products sold) from the Namuimperija.lt online store has the right to: 1) demand that the seller remove the item's defects free of charge, 2) demand that the seller replace the product of inappropriate quality with a product of suitable quality free of charge, 3) demand from the seller to reduce the price accordingly, 4) unilaterally terminate the contract and demand the return of the paid amount.
- Obligations of the buyer
6.1. The buyer must pay for the goods and accept them in accordance with the procedure established by these Rules.
6.2. If the data provided in the Buyer's order form changes, he must immediately inform the Seller about them.
6.3. The buyer, using the Namuimperija.lt online store, undertakes to comply with these Rules, other conditions clearly indicated in the online store and not to violate the laws of the Republic of Lithuania.
- Seller's rights
7.1. The seller has the right to set prices, discounts and other Namuiimperija.lt amounts at his discretion.
7.2. If the Buyer attempts to harm the stability and security of the online store or violates his obligations, the Seller has the right to immediately and without warning limit or suspend his access to the online store or, in exceptional cases, cancel the Buyer's registration.
7.3. In the event of important circumstances, the Seller may temporarily or completely terminate the online store without notifying the Buyer in advance.
7.4. The Seller has the right to cancel the order without notifying the Buyer in advance, if the Buyer does not pay for the goods within 2 working days after choosing to pay by bank transfer.
7.5. When the Buyer chooses the payment method - in cash at the time of delivery of the goods, the Seller, in the event of ambiguities regarding the information provided in the order, contacts the Buyer by the phone number specified in the order. In this case, the term of delivery of the goods starts counting from the day of contact with the Buyer. The Seller has the right to cancel the order without prior notice to the Buyer if the Seller fails to contact the Buyer within 7 working days.
7.6. If the Seller is unable to fulfill the order in a timely and proper manner due to important reasons, the Seller reserves the right to change the terms and time of delivery, or to cancel the order by immediately informing the Buyer and returning the payment if the Buyer has paid it.
- Obligations of the seller
8.1. The Seller undertakes to provide the Buyer with the opportunity to use the services provided by the online store Namuiimperija.lt under the conditions set out in these Rules and the online store.
8.2. The Seller undertakes to respect the Buyer's privacy right to personal information belonging to him, that is, to process the personal data specified by the Buyer only in accordance with Chapter 2 of the Rules and the procedure established by the legal acts of the Republic of Lithuania.
8.3. The Seller undertakes to deliver the goods ordered by the Buyer to the address specified by him under the conditions specified in Chapter 10 of the Rules.
8.4. The Seller, unable to deliver the ordered goods to the Buyer due to important circumstances, undertakes to offer an analogous or similar product as far as possible. If the Buyer refuses to accept an analogous or the most similar product, the Seller undertakes to return the money paid to the Buyer within 3 (three) working days, if prepayment was made.
8.5. After the buyer uses Rule 5.3. the right provided for in point 5.5 of the Rules. clause, the Seller undertakes to return the money paid to the Buyer within 10 (ten) working days, counted from the day of receipt of the returned goods.
- Product prices, payment procedure and terms
9.1. The prices of goods in the online store and in the formed order are indicated in euros.
9.2. The buyer pays for the goods in one of the following ways:
9.2.1. Payment by electronic banking is a payment when the Buyer completes the shopping process by paying through an electronic bank connection to his bank and performing individually necessary actions. All available and implemented payment methods are made through the Paysera.lt system or Payment can be made using electronic banking services of Swedbank, Seb, Luminor, Citadele and Šiaulių bankas. Settlements are possible in euro currency. Payments are processed using MakeCommerce.lt payment platform.
9.2.2. Payment in cash and/or at the time of collection by postman at the time of delivery/collection of the goods - The buyer pays for the goods at the time of their delivery/collection (handover - acceptance) and this service costs 3 EUR.
9.2.3. Payment using the service of concluding consumer credit agreements provided by leasing companies is a payment method when the Buyer (natural person) and the leasing company enter into an agreement on the financing of the purchase of goods in the Seller's online store.
9.3. The Seller reserves the right to demand partial or full advance payment from the Buyer.
9.4. The seller reserves the right to require the buyer to sign the furniture order agreement.
9.5. VAT invoices contain the selected goods, their quantity, discounts granted, the final price of the goods, including all taxes, and other data required to be approved by legal acts regulating accounting.
- Delivery of goods
10.1. When ordering goods, the Buyer can choose the method of delivery of the goods, that is, use the goods delivery service offered by the Seller or the Seller's goods pick-up point (if available).
10.2. Delivery of goods to the Buyer:
10.2.1. The buyer, who has chosen the delivery service during the order, undertakes to indicate the exact place of delivery of the goods.
10.2.2. The buyer undertakes to receive the goods himself or coordinate with the courier/company that delivers the goods. In the event that he cannot accept the goods himself, and the goods are delivered to the specified address and based on other data provided by the Buyer, the Buyer does not have the right to make claims to the Seller regarding the delivery of the goods to the wrong entity.
10.2.3. The goods are delivered by the Seller or his authorized representative.
10.2.4. The delivery (transportation) of the goods and its price are indicated at the time of each purchase.
10.2.5. The delivery (transportation) of goods to the Curonian Spit may take longer than specified. The Seller additionally informs the Buyer about the deadline for the delivery of the goods to the Curonian Spit.
10.2.6. The goods are delivered in the territory of the European Union.
10.2.7. The goods are delivered only to the place where the cargo van can reach.
10.2.8. Goods are not delivered.
10.2.9. Goods can be delivered if possible for an additional fee.
10.2.10. Almost all furniture is delivered unassembled, in boxes, but assembly instructions and fittings are attached to the furniture.
10.3. Collection of goods at the Seller's collection points:
10.3.1. The Buyer can pick up the goods free of charge from the Seller's pick-up point.
10.3.2. The ordered goods must be picked up no later than within 3 (three) working days, counted from the moment of receipt of the Seller's confirmation that the order is ready. If the Buyer does not collect the goods on time, the Seller reserves the right to terminate the order without notice and return the advance payment, if it was paid.
10.3.3. The goods can only be collected by the person who placed the order or the person indicated at the time of placing the order. When picking up the goods, it is necessary to have with you and present to the Seller's employee a valid identity document (identity card, passport or new driver's license).
10.4. The Seller provides the goods to the Buyer in accordance with the terms specified in the product descriptions. These terms are preliminary and do not apply in cases where the Seller does not have the required goods in stock and the Buyer is informed of the shortage of the goods ordered by him. At the same time, the Buyer agrees that in exceptional cases the delivery of the goods may be delayed due to unforeseen circumstances beyond the control of the Seller. In such a case, the Seller undertakes to immediately contact the Buyer and coordinate the terms of delivery of the goods.
10.5. In all cases, the Seller is released from responsibility for the violation of the deadlines for the delivery of the goods, if the goods are not delivered to the Buyer or are delivered late due to the Buyer's fault or due to circumstances beyond the Buyer's control.
10.6. During the delivery of the goods to the Buyer, the Buyer must together with the Seller or his authorized representative check the condition of the shipment and the goods(s) and sign the shipment transfer - acceptance document. After the buyer signs the shipment transfer - acceptance document, it is considered that the shipment is delivered in a suitable condition, there are no product damages, the origin of which cannot be attributed to a factory defect, and there are no inconsistencies in the product(s) package (such as can be determined during the external inspection of the goods). Having noticed that the package of the delivered shipment is damaged (crumpled, wet or otherwise externally damaged), the product(s) is damaged and/or the product(s) is not properly assembled, the Buyer must note this in the shipment transfer - acceptance document and , in the presence of the Seller or his representative, to draw up a free-form act of violation/nonconformities of the shipment and/or product(s). If the Buyer does not perform these actions, the Seller is released from responsibility towards the Buyer for damage to the goods, if the basis for the occurrence of such damage is not a factory defect, and for inconsistencies in the composition of the goods, if these inconsistencies can be determined during an external inspection of the goods.
10.7. If the Buyer fails to hand over the goods within the set deadline and if the Buyer has paid for the Goods and their delivery, the Seller contacts the Buyer and tries to agree on another delivery time. If the Buyer still does not pick up the Goods, such goods are returned to the Seller, the order is cancelled, if the money has been paid, they are returned to the Buyer to the same bank account.
- Product quality guarantee and expiration date
11.1. The characteristics of each product sold by Namuimperija.lt are generally indicated in the product description attached to each product.
11.2. The seller is not responsible for the fact that the color, shape or other parameters of the goods in the online store may not correspond to the real size, shape and color of the goods due to the characteristics of the monitor used by the Buyer.
11.3. Seller provides a 2-year legal guarantee for the goods sold.
11.4. In the event that the Seller does not provide a quality guarantee for certain types of goods, the guarantee provided by the relevant legal acts shall apply.
11.5. The seller provides warranty maintenance services for the goods by mediating between the buyer and the manufacturer or the manufacturer's representative.
11.6. The seller undertakes to perform the warranty service within 15-45 working days.
11.7. Warranty service of goods in the Curonian Spit may take longer than indicated. The Seller informs the Buyer about the warranty period of the goods in the Curonian Spit separately in each case.
- Return and exchange of goods
12.1. The buyer can return the furniture without giving a reason within 30 calendar days, if the item is in its original packaging, unused. The Buyer cannot use this right after concluding one of the contracts listed in Article 6.228-10, Part 2 of the Code of the Republic of Lithuania.
12.2. Defects of the sold goods are removed, low-quality goods are exchanged and returned in accordance with the provisions of the Civil Code of the Republic of Lithuania.
12.3. To return the product(s) 12.2. In the cases indicated in the clause of the rules, the Buyer must inform the Seller by e-mail. by mail info@namuimperija.lt.
12.4. The Buyer can exercise the right provided for in the clause of the Rules within 30 calendar days from the day of delivery of the goods to him, informing the Seller about it 5.3. The procedure provided for in the clause of the rules.
12.5. When returning goods to the buyer, it is necessary to comply with the following conditions:
12.5.1. the returned item must be in its original, neat packaging (this clause does not apply in the case of a defective item being returned);
12.5.2. the product must be undamaged by the Buyer (changes in the appearance of the product or its packaging, which were necessary to inspect the product, cannot be considered as essential changes in the appearance of the product);
12.5.3. the item must be unused, without losing its merchandise appearance (label intact, protective film not torn off, etc.) (this clause does not apply in the case of returning a defective item);
12.5.4. the returned product must be of the same configuration as the one received by the Buyer;
12.5.5. when returning the product, it is necessary to present the document of its purchase.
12.6. The Seller has the right not to accept the goods returned by the Buyer, if the Buyer does not follow the procedure for returning the goods established in this article.
12.7. The Buyer can deliver the returned goods himself. If the Buyer does not have the opportunity to return the goods himself, the Seller undertakes to take the goods and replace them with similar suitable goods. In case the Seller does not have similar goods, he returns the money paid for the goods(s) to the Buyer.
12.8. The return and exchange of goods is carried out in accordance with the provisions of the Civil Code of the Republic of Lithuania.
12.9. We undertake to return the product within 10 days, unless otherwise agreed.
12.10. In all cases, money for returned goods is transferred by payment order and only to the payer's bank account.
- Responsibility
13.1. The buyer is fully responsible for the correctness of the personal data provided by him. If the Buyer does not provide accurate personal data, the Seller is not responsible for the resulting consequences and acquires the right to demand compensation from the Buyer for direct losses incurred.
13.2. The buyer is responsible for the actions taken while using this online store.
13.3. The buyer is responsible for the transfer of his login data to third parties. If the services provided by "Namuimperija.lt" are used by a third person who has connected to the online store using the Buyer's login data, the Seller considers this person to be the Buyer.
13.4. The Seller is released from any responsibility in cases where losses arise because the Buyer, regardless of the Seller's recommendations and his obligations, did not familiarize himself with these Rules, although he was given such an opportunity.
13.5. If the Seller's online store contains links to the websites of other companies, institutions, organizations or individuals, the Seller is not responsible for the information or activities carried out there, does not supervise or control those websites and does not represent those companies and individuals.
13.6. The Seller is not responsible for the proper performance of mutual obligations between the Buyer and the Seller's partners, whose services the Buyer orders.
- Exchange of information
14.1. The seller sends all messages according to 3.2 of the Rules. the procedure provided for in paragraph 1. to the e-mail address provided by the Buyer.
14.2. The Buyer sends all messages and questions using the means of communication specified in the "Contacts" section of the Seller's online store.
- Final Provisions
15.1. If you are not satisfied with the quality of the product purchased from Namuiimperija.lt or the quality of the service provided, notify the administration by e-mail. by post info@namuimperija.lt .
15.2. These rules are drawn up in accordance with the legal acts of the Republic of Lithuania.
15.3. Relations arising on the basis of these rules shall be governed by the law of the Republic of Lithuania.
15.4. All disagreements arising from the implementation of these rules shall be resolved by negotiation. If an agreement cannot be reached, disputes are resolved in accordance with the procedure established by the laws of the Republic of Lithuania.
15.5. These Buying and Selling Rules are updated in 2021. May 14 All changes to the Purchase and Sale Rules will be notified in accordance with 2.6 of these Purchase and Sale Rules. point.
